GOVERNING BODY SELECTION

 

            In compliance with the provisions and limitations set out in I.C. 20-4-10.1, the following constitutes the plan governing the qualifications for, election of, term of office, oath of office, method of filling vacancies, the compensation, and the organization of the Board of School Trustees of the Vigo County School Corporation.

 

Qualifications for Candidates

 

            The qualifications for the Board of School Trustees candidates shall be as follows:

 

                        A member of the Board of School Trustees shall be a qualified voter at least twenty-one (21) years of age, resident of the district in Vigo County from which he is elected at the time of election for at least one (1) year immediately preceding his election, and resident of the state for at least two (2) years immediately preceding his election.  He shall be ineligible to any elective or appointive office under such Board of School Trustees and under the government of Vigo County or any township therein while holding membership on said Board.  He shall not be interested in any contract with, or claim against, the Vigo County School Corporation in which he is elected, either directly or indirectly.

 

            Provided:

 

            That, in some instances, a School Board member may not be prohibited from having a pecuniary interest in or deriving a profit from certain contracts or purchases connected with the Vigo County School Corporation where the affected School Board member makes a written disclosure of his interest in the manner required by I.C. 35-44-1-3(d).

 

Election

 

            The Board of School Trustees shall be elected on a nonpartisan ticket for a term of four (4) years by the voters of Vigo County qualified to vote in the regular November general elections in conformance with the laws of the State of Indiana regulating such elections, including I.C. 1971, 20-4-1-26, Subsection (3), Option (b), including the provision of said act relating to vacancies on the Board.  The members of the School Board shall be elected by residence districts as follows:

 

            District I, three (3) Board members whose residences are within the boundaries of Harrison Township, Vigo County, Indiana.

 

            District II, one (1) Board member whose residence is within the boundaries of Fayette Township, Vigo County, Indiana, or Sugar Creek Township, Vigo County, Indiana.

            District III, one (1) Board member whose residence is within the boundaries of Otter Creek Township, Vigo County, Indiana, or Nevins Township, Vigo County, Indiana.

 

            District IV, one (1) Board member whose residence is within the boundaries of Lost Creek Township, Riley Township, or Pierson Township, all within Vigo County, Indiana.

 

            District V, one (1) Board member whose residence is within the boundaries of Honey Creek Township, Prairieton Township, Linton Township, or Prairie Creek Township, all within Vigo County, Indiana.

 

            If at any time after the election of any member he shall change his residence from the County, he shall be disqualified to continue as a member of said Board of School Trustees and a vacancy shall thereby be created.

 

            At that time provided for by law for the filing of vacancies of candidacies for the general election next following the creation of this Governing Body Selection Plan of the Vigo County School Corporation, nominations for members of the Board of School Trustees of the Vigo County School Corporation may be made by a petition signed by the candidates and ten (10) registered voters residing within the boundaries of the Vigo County School Corporation, which shall be filed with the clerk of the Circuit Court in Vigo County, and such nominations shall be listed by Board members on one separate ballot as other names are listed but without party designations.  Voting and tabulation of votes shall be conducted in the same manner as voting and tabulation in general elections.  The candidate elected from each Board member's district shall be the person having the greatest number of votes.  In the event of a tie vote for any said candidates, the Judge of the Circuit Court shall select one (1) of said candidates who shall be declared the certified elected school trustees.

 

Term of Office

 

            All candidates for membership on the Board of School Trustees shall be voted upon by the voters residing within the boundaries of Vigo County and shall be elected for four (4) years and shall take office and assume their duties on the first day of January after their election.

 

Oath of Office

 

            Every school trustee-elect shall, after his election and at the organizational meeting of the Board of School Trustees, take an oath before one qualified to administer oaths that he possesses all the qualifications required to be eligible as trustee of the Vigo County School Corporation, that he will honestly and faithfully discharge the duties of his office, that he will not while serving as a member of such Board become interested directly or indirectly in any contract with or claim against the Vigo County School Corporation, and

that he will not be influenced during his term of office by any consideration of politics or religion or anything except that of merit and fitness in the appointment of officers and the engagement of employees.  The oath should be taken prior to the beginning of the organizational meeting in January.

 

Vacancies and Method of Replacement for School Trustees

 

            If at any time there shall occur a vacancy on the Board of School Trustees for any reason including but not limited to the failure of the sufficient number of petitions for candidates being filed, and whether the vacating member was elected or appointed, the remaining members of the Board of School Trustees, whether or not a majority of the Board, shall be a majority vote, fill such vacancy by appointing a person or persons from within the residence district or districts where the vacancy or vacancies occurred to serve for the term or balance of terms respectively.  In the event of a tie vote among the remaining members of the Board or their failure to act within thirty (30) days after such vacancy occurs, it shall be the duty of the Judge of the Circuit Court in Vigo County to make such appointment.

 

Compensation

 

            Each school trustee shall receive as compensation for his services the sum as fixed by the Board of School Trustees, but not in excess of two thousand dollars ($2,000.00) per annum.

 

Organization of the Board of School Trustees

 

            The governing body of each school corporation shall, within the first fifteen (15) days of January of each year, organize by electing a president, vice president, secretary, and an assistant secretary, each of whom shall be a different member.  The governing body shall also at such times appoint a treasurer of the governing body and of the school corporation who is a person other than the superintendent of schools, who is not a member of the governing body.  The treasurer may, with the approval of the governing body, appoint a deputy who shall have the same powers and duties as the governing body by regulation or resolution shall provide.
