SCHOOL BOARD LEGAL STATUS
The Constitution of the State of Indiana charges the state with the responsibility of establishing and maintaining a system of public schools for all children in Indiana. The General Assembly fulfills this responsibility by enacting laws to delegate immediate control of the schools to the Board of School Trustees chosen from the respective school corporations, provides for a series of regulations via statutes or regulatory agencies, and provides a portion of the funds needed for the operation of the schools.
The Board of School Trustees, therefore, is an agency of the State of Indiana with powers delegated to it by the General Assembly. The Board is responsible for carrying out certain mandatory laws and shall consider and accept or reject the provisions of the permissive laws. In all cases where the state laws do not provide or prohibit, the Board shall consider itself the agent responsible for establishing and appraising the educational activities of the School Corporation.
